Terms of Service - Focus My Book

1. Acceptance of Terms

By accessing and using Focus My Book ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Focus My Book is a web-based application that provides timer functionality designed to help users maintain focus during reading and work sessions. The Service includes features such as customizable timers, progress tracking, and reading analytics.

3. User Accounts and Registration

To access premium features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

4.1 Subscription Plans: We offer monthly ($5/month) and annual ($40/year) subscription plans. Payment is required at the time of subscription.

4.2 Billing: Subscriptions are billed in advance on a recurring basis. Payment processing is handled by Stripe, Inc. ("Stripe"). You will be charged immediately upon subscription.

4.3 Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

4.4 Refund Policy: We offer a 30-day money-back guarantee for all subscriptions. To request a refund, contact us at support@focusmybook.com within 30 days of your initial purchase. Refunds are processed as follows:

Monthly Subscriptions: Full refund available within 30 days of purchase
Annual Subscriptions: Full refund available within 30 days of purchase
Processing Time: Refunds are processed within 5-10 business days to your original payment method
Eligibility: Refunds are available for any reason within the 30-day window
Partial Refunds: After 30 days, no refunds are provided, but you may cancel to prevent future charges

4.5 Price Changes: We reserve the right to change our pricing with 30 days notice to existing subscribers.

4.6 Failed Payments: If payment fails, we will attempt to process payment again. After multiple failed attempts, your account may be suspended until payment is resolved.

5. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe on intellectual property rights
Transmit malicious code or viruses
Attempt to gain unauthorized access to our systems
Use the Service for any commercial purpose without our consent
Share your account credentials with others

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Focus My Book and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your personal information.

8. Service Availability

We strive to provide reliable service but cannot guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice to users.

9. Limitation of Liability

In no event shall Focus My Book be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless Focus My Book from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
